IPE and Specialty Wood Supplier Terms and Conditions
Caruso Lakeshore Construction & Services ("Caruso") is acting solely as an independent reseller of IPE lumber and related products ("Products"). All Products are supplied by a third-party manufacturer or distributor (the “Supplier”). Any reference to "we," "us," or "our" within these terms shall be understood to mean the original Supplier of the Products, not Caruso. Caruso facilitates the resale and delivery of the Products but does not manufacture, warranty, or assume responsibility for the specifications, quality, or performance of the Products.
Orders that are paid for with a credit card are subject to a 3.5% credit card fee. 
Each line item on a millwork order is subject to an overrun of 5-10% for quantities over 200 lineal feet. For line items ordered in quantities less than 200 lineal feet, the overrun by line item may be higher. Supplier reserves the right to calculate, determine, invoice and receive payment for these overrun quantities. 
Claims must be made by delivering written notice of such claim within 48 hours of delivery or noting such claim on the applicable delivery ticket. 
Any and all claims must be reported (by delivering written notice of such claim within 48 hours of delivery or noting such claim on the applicable delivery ticket) before the priming or staining process begins. 
Natural variations in color and texture in wood products are not to be considered defects unless otherwise agreed to in the applicable Sales Acknowledgement. Change order fees may be assessed, as determined by our sole discretion, if orders are changed after they are placed. 
Lumber orders that have been filled or delivered and are subsequently cancelled are subject to a 25% restocking fee. Client is responsible for any return freight fees, in the event that an order has already been delivered. 
Milled orders cannot be returned and are not available to receive credit against account. Sales on milled orders are considered final unless they are run incorrectly by Supplier. 
Signed drawings constitute Client’s acceptance to be manufactured as drawn and become part of any written contract between Supplier and Client. 
Moulded profiles over 8” are subject to movement (slight twist or cupping) and Supplier can present glue up as an alternative solution at the request of Client, should movement be a concern. 
Air Dried Decking products are subject to shrinkage, checking and cupping, particularly when installed without proper ventilation or in full sun or high temperature conditions. Client shall be liable for any damages to the products resulting from Client’s failure to provide proper ventilation and monitoring of temperature conditions. 
Ipe decking is subject to interlock or ribbon grain that can be difficult to machine. A variable percentage of all the boards in our ipe shipments will contain interlocking grain. 
Wood reacts to changes in temperature and/or humidity. Large and/or rapid changes in these conditions may result in a reaction that can consist of but is not limited to the following; warping, expansion, contraction, splitting, checking, discoloration, separation of joints and the decomposition of adhesives used in the production of the millwork or substrates. Supplier recommends its products be stored and installed in a stable environment with moderate temperatures and a controlled humidity level. Supplier will not cover the cost to repair or replace defects attributed to temperature or humidity, and will not be liable for any damages resulting from Client’s failure to adhere to such specifications. 
Supplier reserves the right to bill all orders that have an agreed upon due date, and then are delayed for delivery by client’s written request. Supplier reserves the right to apply storage fees to materials that have been billed and instructed to be stored until further notice. Supplier facility is an outdoor lumber yard, so material will be kept under cover, but will be exposed to the full ranges of temperature and humidity that occurs in Maryland. As such, Supplier cannot guarantee that milled items stored for multiple weeks or months will meet expected tolerances of freshly milled orders, and will not be responsible for any normal wear and tear on such products resulting from the storage of the products for multiple weeks or months. 
Glue seams that are exposed to exterior conditions are not guaranteed to perform, regardless of the wood or glue type used, and Supplier expressly disclaims any warranties regarding such glue’s performance. 
Material that is damaged in transit when client has arranged freight is not the responsibility of Supplier and all claims should be handled with the carrier hired by client to transport such materials.
