Yearly Dock & Lift Subscription ServicesCaruso Lakeshore Construction & Services ("Caruso") herby agrees to install & de-install the customers ("Customers") lifts, docks, and execute the subscription services listed in customer invoice as early as May 1 or sooner (Installation) and as late as October 31 (Removal) of a given calendar year. The subscription services covers one (1) year minimum starting in the Spring and ending in the Winter, unless service begins during Removal season. Caruso will make reasonable efforts to schedule services with each customer to accommodate their needs.
Caruso is not liable for loss of any property or damage, any personal injury or death due to fire, ice, flood, theft, vandalism, hurricane, tornado or any other cause whatsoever, notwithstanding that any such event may have been caused by the negligence of Caruso or any of its agents, subcontractors or employees and the undersigned customer releases, discharges and covenants not to sue Caruso, its officers, agents, subcontractors and employees, from any and all claims and liability arising out of strict liability or ordinary negligence of such parties which causes the customer injury, death, damages or property damage. The customer further agrees to save, indemnify, and hold harmless Caruso from any claims or damages whatsoever by reason of injury, death, damages incurred by any guest or invitee of the customer and with respect to any property damage or loss sustained by any guest or invitee. The customer further herby waves any right of subrogation on behalf of itself and all parties that may derive rights through the customer as a result of any injuries, death, damages or property damages with respect to which the customer may have become liable. Yearly services will be invoiced in full January 15th each calendar year, and payment is due February 15th thereafter. The Lakeshore Service Agreement and invoice executed between Caruso and Customer shall be renewed automatically yearly unless either party gives written notice to the other at least forty five (45) days before to next invoicing cycle. All pricing is subject to the costs set out in the Lake Shore Service agreement and/or yearly invoice. |
ShoreStation Repair ServicesCaruso is proud to bring ShoreStation products and repair services to your lake! Boat lift owner, or purchasing party executing the invoice for repair services completely indemnify and hold Caruso harmless or liable during or after the transaction of this boat lift repair for any reason. Caruso is not responsible for the state of the lift before or after repairs have been made including but not limited to structural integrity, quality, condition, or working order. Boat lift owner understands that Caruso cannot provide any Warranty or guarantees on used boat lifts that are no longer covered by a ShoreStation active Warranty.
Work type will be denoted in the customer invoice as a Fixed Fee engagement for boat lift repair services. All monies will be owed for the price set forth in customer invoice upon completion of services. Caruso does not act as a parts distributor. Parts ordered as part of a services contract will only be delivered upon installation services being scheduled.
